Terms of Service

1. Who we are

These Terms of Service ("Terms") govern your use of social media management services ("Service") provided by Eneik, LLC ("Eneik Media", "we", "us"), a Delaware limited liability company registered at 131 Continental Dr, Suite 305, Newark, DE 19713, USA.

By placing an order or using the Service, you agree to these Terms.

2. The Service

We provide done-for-you social media content for Instagram and Threads: we create posts, captions, and carousels in your brand voice and publish them automatically. You do not need to log in to any new platform or manage any additional tools.

3. Ordering and payment

Services are ordered and paid through our Stripe payment page. Your subscription begins upon successful payment. All prices are stated in USD unless otherwise specified. Payments are processed by Stripe, Inc. under their own terms.

4. Delivery

Your first content pack will be delivered within 7 business days of your onboarding call. Subsequent content is delivered on a recurring schedule agreed during onboarding. Delivery timelines are estimates and may be affected by your timely provision of brand information and approval.

5. Client approval

We send all content for your review before publishing. You may approve it or request revisions via WhatsApp, email, or another channel agreed during onboarding. Silence for more than 48 hours after delivery is treated as approval unless otherwise agreed.

6. Intellectual property

Upon receipt of full payment for a given period, all content created for you during that period becomes your property. We retain the right to use anonymised or credited examples of our work in our portfolio and marketing materials unless you request otherwise in writing.

7. AI-assisted content

We use artificial intelligence tools as part of our content creation process, including for text generation and image creation. All AI-assisted content is reviewed, edited, and approved by our team before delivery. We are responsible for the quality, accuracy, and appropriateness of all delivered content.

Where we produce AI-generated imagery of human models or persons, such imagery is synthetic and does not depict real individuals unless explicitly stated.

8. Cancellation

You may cancel at any time by emailing us at eneik.group@gmail.com. Cancellation takes effect at the end of your current billing period. We do not charge cancellation fees.

9. Refunds

Refunds are evaluated on a case-by-case basis. If you are dissatisfied with our work, contact us and we will work in good faith to reach a fair resolution. Refunds are at our sole discretion.

10. Limitation of liability

Our total liability to you for any claim arising from or related to the Service shall not exceed the total amount you paid us in the 30 days immediately preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.

11. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute shall be resolved in the courts of New Castle County, Delaware, unless applicable consumer protection law in your jurisdiction requires otherwise.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after the effective date of an updated version constitutes your acceptance of the new Terms. Material changes will be communicated by updating the date at the top of this page.
